Prosecution & Litigation Division
This Division is responsible for conducting prosecutions, and handling litigation matters in Court
The Division comprises of two sections with the following core functions:
1. Prosecution Section
Registers cases in Court for offences committed under the, Companies Commission of Malaysia Act 2002, Companies Commission of Malaysia (Amendment) Act 2015, Companies Act 2016, Interest Schemes Act 2016, Companies Act 1965, Limited Liability Partnership Act 2012, Registration of Businesses Act 1956; Trust Companies Act 1949 and Kootu Funds (Prohibition) Act 1971 and prosecutes cases in the interest of SSM and the public at large as well as attending and representing SSM in appeal cases in the higher Courts.
2. Litigation Section
Attends to civil suits, hearings and appeal matters in relation to cases initiated by or against SSM; conducts research and studies on matters which involve legislative issues for the purpose of handling cases, primarily to determine the authority and provisions of the relevant laws; and prepares affidavits, appeals, written submissions and other document to be filed in Court.

For the purpose of civil suits, all legal documents or cause papers (other than subpoenas) relating to SSM may be delivered to the following address:

Service of subpoenas must be made directly to the specific personnel from the relevant Division or Section within SSM who is in charge of the issue or subject matter of the suit. Should there be any difficulties in identifying the relevant personnel in charge of the issue or subject matter for the purpose of subpoena, please enquire from the Litigation Section.
Notwithstanding the above, should the need arise, SSM reserves the right to object to any service of subpoena to its personnel, in accordance with the due process of Malaysian laws.
