​​​Syarikat E & W Vacuum Technology Sdn Bhd Dan Pengarah Syarikat Disabitkan Dengan Kesalahan Ketidakpatuhan Di Bawah Akta Syarikat 1965


Georgetown – Khamis, 1 September 2016: Syarikat E & W Vacuum Technology Sdn Bhd (876836-V) dan pengarah-pengarah syarikat iaitu Lee Lie Keow dan Teh Chze Yang telah didapati bersalah bagi kesalahan di bawah seksyen 370(1) Akta Syarikat 1965 di Mahkamah Majistret Georgetown. Syarikat dan pengarah-pengarah syarikat diwakili oleh Khoo Teng Ju. Pada 26 November 2015, syarikat dan pengarah-pengarah syarikat telah disabitkan bagi kesalahan di bawah seksyen 165(4) Akta Syarikat 1965 di mana syarikat dan pengarah-pengarah syarikat akan dikenakan penalti ingkar berjumlah RM30 sehari bagi syarikat dan setiap pengarah syarikat sekiranya gagal menyerahsimpan Penyata Tahunan bagi tahun 2012 hingga 2014 sebelum 24 Mac 2016. Syarikat telah menyerahsimpan Penyata Tahunan bagi tahun 2012 hingga 2014 pada 24 Ogos 2016 iaitu 5 bulan selepas tarikh yang ditetapkan. Mahkamah telah menjatuhkan hukuman denda ke atas syarikat dan pengarah-pengarah syarikat sebanyak RM4,500 untuk kesalahan penalti ingkar dari 24 Mac 2016 hingga 24 Ogos 2016. Di dalam rayuan mitigasi, Khoo Teng Ju memohon agar jumlah denda dikurangkan atas alasan syarikat mengalami kerugian. Majistret Mohd Amin Shahul Hamid telah menolak alasan tersebut kerana terdapat keputusan kes pada 26 November 2015. Pengarah-pengarah syarikat membayar denda yang ditetapkan. Pendakwaan dikendalikan oleh Pegawai Pendakwa SSM Muhammad Nasrizal Saidin bagi pihak SSM. Hukuman yang dijatuhkan oleh Mahkamah diharapkan memberi peringatan kepada syarikat dan pegawai-pegawai syarikat agar sentiasa mematuhi Akta Syarikat 1965.

Georgetown – Thursday, 1 September 2016: E & W Vacuum Technology Sdn Bhd (876836-V) and company directors Lee Lie Keow dan Teh Chze Yang were found guilty for an offence under section 370(1) Companies Act 1965 by Georgetown Magistrate Court. The company and its directors were represented by Khoo Teng Ju. The company and its directors were convicted on 26 November 2015 for an offence under section 165(4) Companies Act 1965 whereby the company and directors will be imposed with default penalty amounting to RM30 per day if the company and directors fail to lodge Annual Return for year 2012 until 2014 before 24 March 2016. The company had lodged the Annual Return for year 2012 until 2014 on 24 August 2016 which is 5 months after the fixed date. The Court sentenced the company and directors a fine of RM4,500 as default penalty for the period beginning 24 March 2016 until 24 August 2016. The directors paid the fine. In mitigation, Khoo Teng Ju appealed for a lower fine as the company is suffering losses. Magistrate Mohd Amin Shahul Hamid dismissed the appeal on the ground that a prior decision had already been made on 26 November 2015. CCM Prosecuting Officer Muhammad Nasrizal Saidin prosecuted on behalf of CCM. The sentenced meted out by the Court is a reminder to companies and its officers to continuously abide by the provision of Companies Act 1965.
