Monday, 18th April 2016: Praemavathy A/P C Sinnadurai, 58, director of Sentinel Security Services Sdn Bhd was charged at the Sessions Court of Kuala Lumpur for committing an offence under Section 364(2) of the Companies Act 1965. The charge was on allegation that the accused made a false statement involving Sentinel Security Services Sdn Bhd pertaining to the resignantion of one Sorabyby binti Abu Bakar as the company’s director. The offence was committed at Menara SSM@Sentral, No. 7, Jalan Stesen Sentral 5, Kuala Lumpur Sentral between 16th March and 19th March of 2015.

The offence under Section 364(2) CA 1965 carries a maximum penalty of 10 years imprisonment or a maximum fine of RM250,000.00 or both.

Session Court Judge, Tuan Zulqarnain Hassan, set bail at RM5,000 with one surety for charge and fixed 10th May 2016 for mention.

Prosecuting officer from SSM, Mohd Iqbal Mohd Yusoff and Lidia Fyrulliza Ishak appeared on behalf of the Public Prosecutor meanwhile the accused unrepresented.

PENGARAH SYARIKAT SENTINEL SECURITY SERVICES SDN BHD DIDAKWA MENGIKUT SEKSYEN 364(2) AKTA SYARIKAT 1965 KERANA MEMBUAT PERNYATAAN PALSU KEPADA PENDAFTAR SYARIKAT (‘SSM’)

Isnin, 18 April 2016: Seorang pengarah syarikat kawalan keselamatan, Sentinel Security Services Sdn Bhd, Praemavathy A/P Sinnadurai, 58 tahun, didakwa di Mahkamah Sesyen Kuala Lumpur kerana telah melakukan satu kesalahan di bawah seksyen 364(2) Akta Syarikat 1965 (‘AS 1965’) dengan membuat satu pernyataan palsu berkaitan peletakan jawatan Sorabyby binti Abu Bakar sebagai pengarah syarikat Sentinel Security Services Sdn Bhd dalam Borang 49 bertarikh 16 Mac 2015.

Kesalahan di bawah seksyen 364(2) AS 1965 memperuntukkan hukuman penjara 10 tahun atau denda sehingga RM250,000 atau kedua-duanya sekali jika sabit kesalahan.

Hakim Tuan Zulqarnain Hassan memerintahkan Praemavathy diikat jamin RM5,000 dengan seorang penjamin dan kes akan disebut semula pada 10 Mei 2016.

Pendakwaan kes dikendalikan oleh Mohd Iqbal Mohd Yusoff dan Lidia Fyrulliza Ishak, pegawai pendakwa SSM manakala Praemavathy tidak diwakili oleh peguam.
