Registration of Federation insurers
Section 5. Appeal against refusal of registration.
(1) Where the Commissioner, refuses registration (other
than on the direction of the Minister), either generally or in respect of a particular class of business, the applicant may require the refusal to be referred to a referee appointed by the Minister.
(2) On any such reference-
(a)
the referee shall investigate the application, and afford to the applicant, and to the Commissioner an opportunity of making representations, either orally or in writing or in both ways, as the referee may determine; and
(b)
after considering any representations made to him the referee shall report to the Minister.
(3) The Minister shall consider the report of the referee and, after consultation with the Commissioner, shall confirm or quash the refusal, or confirm it as respects one class of business and quash it as respects the other.
(4) If the refusal is quashed as respects either class of business, then (subject to sub-section (6) of section 4), the Commissioner shall register the applicant in respect of that class of business.
