Section 12. Amendment of section 12

12. Section 12 of the principal Act is amended—

(a) in subsection (1)—

(i) by substituting for paragraph (a) the following paragraph:

"(a) being a person required to register his business under this Act carries on that business without registering the business; or";

(ii) in paragraph (b), by substituting for the words "the certificate of registration issued in respect thereof" the words "the period of registration";

(iii) in paragraph (e), by substituting for the words "an inspector in the performance of his duties" the words "the Registrar, any inspector or any other officer of the Commission or any public officer in the performance of his duties"; and

(iv) by substituting for the words "shall be liable to imprisonment for a term not exceeding six months or to a fine not exceeding one thousand ringgit or both" the words "commits an offence and shall on conviction be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both"; and

(b) in subsection (2)—

(i) by deleting the words "or a certified copy thereof";

(ii) by substituting for the words "section 5" the words "section 11A"; and

(iii) by substituting for the words "shall be liable to a fine of two hundred ringgit" the words "commits an offence and shall on conviction be liable to a fine of two thousand ringgit or to imprisonment for a term not exceeding six months or to both".
