What are the requirements to register a sole proprietorship or partnership?

  • Owner/partner must be a Malaysian Citizen or Permanent Resident of Malaysia.
  • Aged 18 years and above.
  • Business must be carried out in Peninsular Malaysia or Federal Territory of Labuan.

What is the type of business can be registered?

Two type of business :

  • Sole proprietorship (one owner)
  • Partnership (2 to 20 owners)

How to register a business?

A. If the applicant is using his own name in MYKAD/MYPR as the business name:

  • Complete Form A (Registration of a New Business together with copy of his identity card.
  • Registration fee RM30.00
  • Business info fee is RM10.60 (Inclusive GST)
  • Sole proprietorship only

B. If the applicant is using a trade name as the business name:

  • The applicant needs to submit an application for approval of the business name (Form PNA.42); and
  • Complete Registration of a New Business (Form A); and
  • Registration fee RM60.00
  • Business info fee is RM10.60 (Inclusive GST)

C. Documents to be attached to:

  • MYKAD/MYPR
  • Letter of approval from Government Agency (if applicable).

D. Registration can be done at any SSM counter or through online via ezBiz Online services at ezbiz.ssm.com.my.

How to register a business through ezBiz Online?

  • The service is available 24 hours a day, 7 days a week by accessing ezbiz.ssm.com.my.
  • Owner and business partner should register as an ezBiz Online user and present at the nearest SSM for activation once in a lifetime.
  • As a registered user, you can access the ezBiz Online portal and register the business

Can a company registered under the Companies Act 1965 start a business under the Registration of Businesses Act 1956?

Pursuant to section 4 of the Registration of Businesses Act 1956, this Act is not applicable for a business which is exclusively owned and carried on by any company registered under the Companies Act 1965.

What is the form to be used for changes of business particulars such as business address, nature of business, branch address and particular of partner?

Registration of Changes of Business Particulars is by way of Form B. The Owner or partners is to notify the Registrar within 30 days from the date of changes of the following areas : 

  • Principal business address
  • Type of business
  • Branch(s) particulars
  • Particulars of owner or partners

Registration fee is RM20.00 and business info is RM10.60 (inclusive GST)

Can a partnership change its status to sole proprietorship?

A partnership can change its status to a sole proprietorship or from sole proprietorship to partnership (trade name) by registering such a change using (Form B) and registration fee is RM20.00.

Can a business change the business name?

There is no provision under the Registration of Businesses Act 1956 that allows a business to change its name. Owner or partners need to register a new business.

How to renew a Business Registration Certificate?

Renewal of Business Registration can be done via SSM's service counter (form A1), ezBiz Kiosk, ezBiz Online portal at ezbiz.ssm.com.my, Bank Simpanan Nasional or selected Bank Kerjasama Rakyat Berhad:

  • Business (personal name) - RM30.00 per year
  • Business (Trade name) - RM60.00 per year

Renewal of business registration may be made at any time before the expiry of the registration.

Can a business that has expired more than 12 months be renewed?

It is not allowed. Owner or partners need to re-register the business.

What is the period of new registration or renewal for a business?

The business can be registered or renewed for a period of one (1) to five (5) years and not exceeding five (5) years with the specified prescribed fee.

How to register the termination of business?

  • Notify the Registrar within 30 days from the date the business ceased operation
  • In the case of the death of the owner of the business, the person responsible or the next –of-kin of the deceased owner shall within 4 months from the date of such death notify the Registrar. 
  • Complete Notification of Termination of Registered Business ((Form C) for active business. Form C is not required to be submitted for business that has expired.

How to confirm the termination of the business if Form C is not submitted?

Owner may purchase The Confirmation Letter on expired business at the nearest SSM counter or through e-Info services.

Where can the Business Registration Form be obtained?

Business Registration Form can be obtained at any SSM counter either SSM Headquarter or State Office excluded Sabah and Sarawak. Forms also can be download from website SSM (www.ssm.com.my)

Where to submit the Business Registration Form?

Business Registration Form can be submitted at any SSM counter either Headquarter or State Office excluded Sabah and Sarawak. Application can also be submitted through ezBiz Online portal by browsing website SSM (ezbiz.ssm.com.my)

Is there any changes to complete the Business Registration Form (Form A)?

The following is the changes to complete Form A :

Complete main information such as principal business address, date of commencement of business, type of business, branch address (if any) and owner information. The differences are as follows :

  • If there are more than two branches, complete the additional branch address in the new sheet of the second page of Form A. 
  • If there are more than two owners, complete the additional information of owner in the new sheet of the second page of Form A. The owners named in the information of owner must be the same owner who signed at the verification by sole proprietor/partnership’s column in the same page.
  • Complete the name, MYKAD/MYPR number and signed the last part of Form B in front of the counter staff before payment.

Is there any changes to complete the Registration of Changes od Business Particulars (Form B)?

The following is the changes to complete Form B :

  • Changes of principal business address, type of business, branch address and owner information must be complete in the same Form B.
  • Ticked at the appropriate box and complete the relevant information. 

Example: Ticked the changes of principal business address and complete Information A. 

  • Complete the name, MYKAD/MYPR number and signed the last part of Form B in front of the counter staff before payment.

Is there any changes to complete the Notification of Termination of Registered Business (Form C)?

The following is the changes to complete Form C :

  1. Marked the type of termination and the termination date on the same line.
  2. Complete the name, MYKAD/MYPR number and signed the last part of Form C in front of the counter staff.

Is there any changes to complete the Business Renewal Form (Form A1)?

The following is the changes to complete Form A1: 

Complete the renewal information. The differences are as follows :

  1. Complete and update latest mobile phone number (if any)
  2. Complete the detail of owner’s full name, MYKAD/MYPR no. and mobile phone number. Form A1 may be signed by the owner or the person responsible (OYB).

Why the owner needs to fill up the latest mobile phone number?

The latest mobile phone number will be updated in the business owner’s database in the CBSROB System. It will be used to provide such information  to the owner in the event of renewal reminders or other programs organized by CCM in the future.
